1. Introduction 

Welcome to Digiscape! Your privacy is of utmost importance to us. Digiscape is committed to protecting the confidentiality of information entrusted to it by Users, and has prepared this Privacy Policy to inform Users of Digiscape’s practices concerning the collection, use, maintenance and disclosure of personal information.  

 

By using our app, you agree to the terms laid out in this Privacy Policy.  This Privacy Policy will help you understand what information we collect, how we use it and what choices you have when you play any of our games or use any of our apps, use our websites, buy merchandise from us, or take part in live events and promotions (the "Services").

 

Our Privacy Policy is designed to give you a comprehensive understanding of the steps that we take to protect the personal information that you share with us, and we would always recommend that you read it in full.

 

2. What is covered?

This Privacy Policy covers Digiscape’s treatment of personally identifiable information (“Personal Information”) collected by the company when a User accesses and uses Digiscape’s website and while using Digiscape’s apps and services. This Privacy Policy also covers Digiscape’s subsidiaries, affiliates and business partners.  This Privacy Policy does not cover aggregated and/or anonymized data from which the identity of an individual cannot be determined. Digiscape retains the right to use aggregated and/or anonymized data in any way Digiscape deems appropriate.

 

Digiscape has no control over the content of third party websites that may be identified on Digiscape’s website or, if applicable, accessed through hyperlinks on Digiscape’s website. Some examples are using citations from credible sources & governing accreditations.

 

 

3. Information Collected

As a User browses Digiscape’s website or application, Personal Information including without limitation a Username and email address that a User provides, as well as information that is collected electronically concerning a User’s use of Digiscape’s website, via cookies or third party software. “Cookies” are files or information that is stored on a User’s computer hard drive when a User visits Digiscape’s website, and are used to remember that assist a User in the future use of the Digiscape’s website and application. Most internet browsers are set up to accept cookies. If a User does not wish to accept cookies, a User can adjust its internet browser to refuse the use of cookies or alert the User when cookies are being transmitted.

 

Digiscape may collect other information about a User, including without limitation the server that a User’s computer is logged onto, a User’s browser type (e.g., Internet Explorer, Microsoft Edge, Google Chrome), and the pages a User views or requests. This type of information, however, will only be collected in the aggregate in connection with all Users of Digiscape’s website for tracking, planning, forecasting and/or evaluation purposes.

 

  • Some of our Services require you to register with us or sign up for an account before you can use them. Where this is the case, you provide us with information including your in-app username that you choose to use on our Services. We collect and use this information in order to authenticate you when you register an account and use the Services, to make sure you are eligible and able to receive the Services, and so that you receive the correct version of the Services.
  • You may be required to have an account with a supported external single sign-on service in order to use some of our Services. Where this is the case, the Personal Data we collect also depends on which external accounts you choose to use, their privacy policy, and what your privacy settings with those services allow us to see when you use their services to access Digiscape Services.
    • If you choose to link your Google account to the Services, we will collect your Google email address and an authentication token provided by Google.
    • If you choose to link your Facebook account to the Services, we will collect a unique user ID provided by Facebook and, if permitted by you, your Facebook registered email address.
    • If you choose to link your Apple account to the Services, we will collect your email address on file with your Apple ID account or a private relayed email address if you use the Hide My Email option provided by Apple.
  • Depending on the particular Service you sign up for, we may support other external single sign-on services and collect additional Personal Data from them. Some external providers may notify you that they make additional information, such as your public profile, available to us when you use their single sign-on services. We do not collect that information from them.
  • We collect and use your device location information as you use our Services (and, if you elect to turn on background location tracking for participating Services, while you are not directly interacting with these Services), including how you move around and events that occur during in app activity or gameplay. Our Services include location based games whose core feature is to provide an experience tied to your real world location, so we need to know where you are to operate these apps and games for you, and to plan the location of in-game resources. 
  • We also collect and use your in-game or in-app actions and achievements, as well as certain information about your mobile device (including device identifiers, device OS, model, configuration, settings, and information about third-party applications or software installed on your device), to operate the Services for you and to personalize your gameplay and user experience. We will also generate an internal account ID when you use certain Services to associate you with an account.
  • We also use the information above to show in-game sponsored locations that are in your vicinity as part of the gameplay experience.
  • We further use the information above in order to provide technical and customer support to you.

 

In addition, we have and rely on a legitimate interest in using your Personal Data as follows:

  • Using your contact information, namely your email address in order to communicate with you to provide technical and customer support.
  • Using your internal account ID and in-game username in order to attribute to your account any user content that you elect to submit to Digiscape through the Services. 
  • Using your email address and device information in order to share updates and news with you either within the apps or by email. 
  • Analyzing your in-game actions and achievements to show you rewards, promotions, or other offers about our Services that are tailored to your personal user experience. 
  • We collect content you provide such as images and/or text to provide social features within our games and apps so you can interact and play with other players, including storing your content, and other information shared with those players.

  • To improve the features that we offer you through the Services, or to provide you with new or additional features for our Services.
  • Using your in-app actions and achievements, as well as certain information about your mobile device (including device identifiers, device OS, model, configuration, settings, and information about third-party applications or software installed on your device), to carry out anti-fraud and anti-cheating measures against behaviors prohibited under our Terms of Service, to prevent abuse, and to provide a fair gaming experience to all players.
  • To make legal or regulatory disclosures and to establish, exercise, or defend legal claims.

 

4. User Consent

A User’s providing of Personal Information to Digiscape shall be deemed to mean that a User acknowledges this Privacy Policy, and provides express informed consent to Digiscape’s collection, use, maintenance and disclosure of said User’s Personal Information in accordance with this Privacy Policy. If, for some reason, a User does not agree with the terms of this Privacy Policy, then said User should not, and is requested not to, provide any Personal Information to Digiscape. Certain services offered by Digiscape, however, can only be provided if a User provides Personal Information to Digiscape. If a User chooses not to provide Digiscape with certain required personal information, the User may not be permitted to obtain certain services.

 

5. Information Used

 

Digiscape may use Personal Information it has collected through its website, in order to (a) provide a User with a service or software offered by Digiscape or one of its subsidiaries, affiliates and business partners, (b) measure a User’s interest in certain services or software or to inform a User about a service or software offered by Digiscape or one of its subsidiaries, affiliates and business partners, (c) understand a User’s preferences in order to enhance a User’s experience with Digiscape or one of its subsidiaries, affiliates and business partners, (d) measure and attempt to predict the effectiveness of the marketing and sales effort of Digiscape or one of its subsidiaries, affiliates and business partners.

 

In addition to the foregoing, if a User has provided its email address to Digiscape or to a company Digiscape has partnered with to make their products and services available to the User, Digiscape may send the User email offers and information. Digiscape may send a User email offers if the User has provided its email address to a third party and has actively chosen or requested, on an opt-in basis, to receive email offers from other parties.

 

Digiscape does not, however, provide a User’s email address to its business partners. Digiscape may, however, send a User offers on behalf of its subsidiaries, affiliates, and business partners. If a User’s email address is html-enabled, Digiscape may choose to send a User graphic-rich html emails.

 

6. Information Sharing and Disclosure

Digiscape uses all information collected from a User for internal purposes only. Digiscape does not sell your data and will not sell your Personal Information to anyone. We do not at any time in the future intend to sell or market your data.  Digiscape may, from time to time, send Personal Information about a User to other persons or entities that perform services on behalf of Digiscape (“Service Providers”), but only when:

 

● The Service Provider has agreed to use such information solely for the purposes of providing services to Digiscape;

● The Service Provider agrees to protect such information in the Digiscape manner as the policies set forth in this Policy Statement;

● Digiscape has obtained the User’s consent to share the information;

● Digiscape needs to share the User’s information in order to provide the service the User has requested;

● Digiscape needs to send the information to a Service Provider who works on behalf of Digiscape to provide a service to you.

● Unless Digiscape informs a User otherwise, a Service Provider does not have any right to use the Personal Information Digiscape provides to them beyond what is necessary to assist Digiscape, or in response to a legal obligation including without limitation a subpoena, court order or Digiscape believes that the law requires disclosure, or where the information is currently in the public domain.

 

​​7. Maintenance and Security of Personal Information

Digiscape holds all of the Personal Information in the United States at this time. Digiscape keeps a User’s Personal Information for as long as Digiscape determines necessary to fulfill the objective for which it was collected. Said Personal Information is maintained on Digiscape systems that are protected using security measures. Unfortunately, however, Digiscape cannot guaranty that the information submitted to, maintained by or transmitted from Digiscape is or will always be completely secure, as transmission of information over the internet is oftentimes susceptible to potential interception, misuse, willful and/or negligent acts or omissions, misrouting, or possible loss.

Unless stated otherwise for a particular Service, children are not allowed to use the Services, and we do not knowingly collect Personal Data from them. We define “children” as follows:

Residents of the UK: anyone under 13 years old.

Residents of the EEA: anyone under 16 years old, or the age needed to consent to the processing of personal data in your country of residence.

Residents of the Republic of Korea, anyone under 14 years old.

Residents of other regions: anyone under 13 years old.

Any changes shall be effective from the date of posting of any revisions hereto as well as to any existing information then being retained by Digiscape.
